Welcome to Bitewith! These Terms & Conditions (“Terms”) govern your access to and use of the Bitewith mobile application, website, and related services (“Platform”). By accessing or using Bitewith, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.

1. Definitions

• “User” refers to any person using the Bitewith Platform to order food or services.
• “Restaurant/Partner” refers to restaurants, food providers, and delivery partners listed on Bitewith.
• “Order” refers to food or beverage requested via the Bitewith Platform.
• “We/Us/Our” refers to Bitewith Technologies Pvt. Ltd. (or equivalent legal entity).

2. Service Role of Bitewith

• Bitewith is a technology platform that connects users with restaurants and delivery partners.
• Bitewith does not prepare food and is not responsible for the quality, safety, or preparation of food items.
• Responsibility for food safety and quality lies with the respective restaurant.

3. User Responsibilities

• Provide accurate information (name, address, contact details).
• Ensure availability to receive deliveries.
• Do not misuse the platform (fraudulent orders, multiple accounts, abusive behavior).
• Use the service only for lawful purposes.

4. Orders & Payments

• All orders placed are considered final once confirmed.
• Payments must be made via the available payment methods on the platform.
• Bitewith is not responsible for delays or failed transactions caused by third-party payment providers.

5. Cancellations & Refunds

• Customer cancellations are not allowed once an order is placed.
• Refunds are governed strictly by the Bitewith Refund Policy.
• Bitewith reserves the right to cancel orders at its discretion (e.g., restaurant unavailable, delivery partner unavailable).

6. Delivery

• Delivery times are estimates and may vary due to traffic, weather, or operational issues.
• Bitewith is not liable for delays beyond its reasonable control.
• Risk of food items transfers to the customer once delivered.

7. Intellectual Property

• All content on Bitewith (logos, text, graphics, software) belongs to Bitewith.
• Users may not copy, distribute, or exploit any part of the platform without written consent.

8. Limitation of Liability

• Bitewith is not responsible for food preparation, taste, packaging, or restaurant hygiene.
• Bitewith is not liable for indirect, incidental, or consequential damages.
• Maximum liability of Bitewith, in any case, shall not exceed the order value.

9. Account Suspension & Termination

• Bitewith may suspend or terminate accounts involved in misuse, fraud, or violation of these Terms.
• Users may delete their account by contacting Bitewith support.

10. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes will be subject to the exclusive jurisdiction of courts located in Bhopal, India.

11. Amendments

• Bitewith may update these Terms at any time without prior notice.
• Continued use of the platform after changes implies acceptance of the updated Terms.
